Prominent property investor and entrepreneur Zaki Amer has successfully appealed his conviction in the New South Wales District Court in Parramatta, overturning a previous district court decision. On this appeal, the court amended the previous conviction for the $1,250 fraud charge, with Mr Justice Colefax granting section 10(1)(b) without recording the conviction.
SYDNEY, October 4, 2024 (Newswire.com) – This case arose from an isolated incident involving a relatively small amount of $1,250 and was thoroughly reviewed during appeal. The court acknowledged mitigating factors, including significant steps taken by Amer since the incident, including repaying the amount in full and addressing the underlying pressures that contributed to the situation.

During the appeal, Ameer’s defense team, comprising eminent barrister Philip Strickland SC of Forbes Court and Ameer’s lawyer Jasmina Seikh, argued that the crime occurred under difficult circumstances, including the psychological pressures of 2020. He emphasized that he did.
The court found that the case did not warrant a conviction, especially given the small amount of money involved and the fact that Amer had made full restitution before being indicted. In its court filing, NSW Fair Trading also did not oppose the acquittal.
